Consultation Draft

 

Introduction

The Competition Commission (the Commission) indicated in its consultation draft on the rules of procedure for appeals in energy code modification cases (the Energy Code Modification Rules) that it would additionally seek views on some complementary draft guidance. The Commission has now published a consultation draft of the guidance and seeks views on it. The guidance is designed to assist parties to these new appeals to understand the Commission’s procedure.

Closing date

Responses should be received by 28 February 2005.

Date of implementation

It is anticipated that the appeal provisions of the Act will be given effect on or shortly after 1 April 2005.

The guidance

The guidance should be considered alongside the Rules.

We shall welcome comments on whether the guidance properly covers all the material which a party to these appeals would want to be aware of and whether any important topics have been neglected.

A particular practical point we should like views on is whether parties and their representatives are likely to prefer to use electronic media for the exchange of documents and if so whether they would wish to use encryption either routinely or occasionally
