GUIDANCE ON THE APPLICATION OF THE COMPETITION ACT 1998 IN THE WATER AND SEWERAGE SECTORS - CONSULTATION

I enclose a consultation on our revised guidance on the application of the Competition Act 1998 in the water and sewerage sector.

The guidance was originally published in February 2000 just before the Competition Act 1998 came into force. Since then, the Office of Fair Trading (OFT) and some of the other concurrent regulators have updated their guidance to take account of such things as changes in EC competition law, and the Enterprise Act. We have updated our guidance to take account of these factors, as well as the Water Act 2003 and the introduction of the water supply licensing regime (WSL), and the change to Ofwat's structure (becoming the Water Services Regulation Authority).
